PARTNER VISAS

This visa allows partners (spouse, fiancé, de facto or interdependent partner) of Australian Citizens, permanent residents and eligible New Zealand Citizens to migrate and live together in a genuine and ongoing relationship.

SPOUSE (SUBCLASSES 309/820 AND 100/801)

Applicants can apply for a Spouse visa from inside or outside Australia and is initially granted as a temporary visa. Relationship is reassessed again after two years before a permanent visa is granted to the Spouse Visa holder.

Requirements:

  • You must be either legally married to or in a de facto relationship with an Australian Citizen or permanent resident or and eligible New Zealand citizen.
  • All spouse visa applicants must be sponsored by their partners.
  • Onshore applicants (subclass 820/801) must hold a valid substantive visa at the time of application except in exceptional circumstances.
  • Offshore applicants (subclass 309/100) must be outside Australia at the time of application and grant of visa.
  • All visa applicants must satisfy health and character requirements.

PROSPECTIVE MARRIAGE VISA (SUBCLASS 300)

This visa allows fiancé(e)s of Australian citizens, Permanent residents or eligible New Zealand Citizens to enter Australia to marry their fiancé(e) and is valid for nine months. Prospective marriage visa holders are entitled to apply for a spouse visa in Australia after they have married their fiancé(e).

Requirements:

  • The applicant must be engaged to an Australian citizen or Australian permanent resident or an eligible New Zealand citizen.
  • All prospective marriage visa applicants must be sponsored by their fiancé(e) (must be at least 18 years of age).
  • Visa application must be lodged while applicant is offshore.
  • All visa applicants must satisfy health and character requirements.
