Partner Visas

Partner Visas of Australia also known as de facto visas provided to the partners and spouse. You have to be a permanent residence, Australian Citizen or eligible New Zealand citizen Living In Australia. The Partner visas can be applied for both Opposite or same-sex couples.

However, in Australia, there are three types of visas for partners available.

  • Prospective Marriage Visa (subclass 300) for a fiance
  • Partner Visa Offshore (subclass 309 and 100) To apply overseas
  • Partner Visa Onshore (subclass 820 and 801) To apply in Australia

There are two different stages to apply for partner visas in Australia, First, the applicant must have to apply for provisional partner visas also known as temporary partner visas.

The temporary partner visas are categorized as subclass 309 for the applicants applying outside Australia and subclass 820 for applicants applying within Australia.

You are allowed to stay in Australia temporarily while your permanent partner visas get processed or withdrawn.

Prospective Marriage Visa (subclass 300)

With a Prospective marriage visa you are allowed to come to Australia for 9 months (from the date your visa is granted) to marry your prospective partner who has Australian Citizenship, Permanent Residency, or eligible New Zealand Citizen. The subclass 300 visa is also known as the fiance visa the applicant must be living outside Australia to obtain this visa.

Partner Visa Offshore ( subclass 309 / 100)

This Visa lets the same-sex partner or spouse of a Permanent resident of Australia, Australian Citizen, or eligible New Zealand citizen temporarily live in Australia.

You will be given a visa with a subclass 309 which is a temporary partner visa, This is the first step that leads towards permanent partner visa subclass 100. You must apply for this visa from outside Australia.

Partner Visa Onshore ( subclass 820 / 801)

The partner visas Offshore and offshore have basically the same requirements and benefits. The main difference between these two is that for Onshore the applicant must be in Australia while applying.

Same as subclass 309, you will be assigned a temporary visa until the Home affairs of Australia decides your permanent partner (Migrate) application or application is withdrawn.

Partner Visas Processing Time

There are no confirmations on how much time it takes to get your visa process, However, on average it takes between 16 to 24 months. The processing times depend on the response of the department, sometimes the department responds to early applications, and sometimes it only responds to the application after the published dates on their websites. The application processing depends on some different factors which include.

  • The attached supported documents of the applicant are complete
  • How promptly applicants respond to the additional information queries.
  • The time to complete additional information of applicant such as health, national security, character, and background of the applicant.
  • The final decision will be made after checking the collected information and authenticity of the applicant.

We recommend you apply for your partner visa prior to your intended travel time so that you will be able to get your visa on time.

Basic Requirements of Partner Visas:

  • You must meet the relationship requirement
  • You must have a sponsor.
  • Applicant must be the age of 18 or older
  • Meet the Health Requirement and Character requirement.
  •  Applicants must not have previously canceled or refused a visa application.
  • Must not have in debt to Australian Government
