Child Visas

Australian Child Visas has various options for the sponsors to apply for a visa for their children to join their parents in Australia. The parents sponsoring the child must be an Australian Citizen, a Permanent resident in Australia, or an eligible New Zealand Citizen. The Partner of the child-parent might become the sponsor of the child in some cases.

The child eligible for the Australian visas are being;

  • An under 18 years old age child
  • Age is between 18 to 25, and a full-time student, and dependent on parents
  • An 18 years of age or older and not be able to work because of a disability and the child is dependent on parents.

However, In Australia, There are four different visa options for your child are available to apply for.

  • Child Visa (Subclass 101) For Offshore
  • Child Visa (Subclass 802) For Onshore.
  • Dependent Child Visa (Subclass 445).
  • Adoption Visa (Subclass 102)

There are two permanent visa options for your child’s migration. The first one is 101 Child visa which is for the child outside Australia, and the other is 802 Child Visa for the child Currently in Australia.

The Overall process and requirements are the same for both of the permanent child visas. The main difference in both of these is only the current location of your child.

Other than that, The dependent child Visa (Subclass 445) allows the child of a parent living temporarily on the 1st stage of partner visa to stay in Australia with their parents.

And the Adoption visa (Subclass 102) allows the parents to sponsor and have their adopted child living outside Australia to live with them in Australia.

Child Visa (Subclass 101/802) Benefits & Requirements

To apply for the child visa, You must meet certain requirements. As the requirements of Child Visa Subclass 101 and Subclass 802 are the same, we have enlisted them together. Below are the requirements for Child Visa 101 and Child Visa 802

  • The child must be dependent on their parents.
  • Before submitting the application, you must have a sponsor
  • Applicant must meet the age requirement
  • Applicants must not have any partner or other relationship.
  • Meet other basic requirements such as health, character, and best interest of the child.
  • The applicant has to submit the written consent to migrate to Australia.
  • The application should not have been rejected or refused by DHA on a previous visa application.

When it comes to Child Visa (Subclass 101) & Child Visa (Subclass 802) benefits, these benefits are the same as the permanent resident has.

  • A child can stay in Australia indefinitely
  • The child can work and study in Australia when eligible
  • The child can enroll in Australia’s public healthcare scheme, Medicare
  • If eligible, the child can sponsor relatives to come to Australia
  • The child apply for Australian Citizenship, if eligible

Dependent Child Visa (Subclass 445) Benefits & Requirements

As the dependent visa is a short-term visa for a child, there aren’t any strict requirements on this visa. However, the visa will be valid until the department of home affairs decides on a child partner visa application.

If the application gets noticed within a week and the decision will be taken, your visa will expire in a week.

Below are the basic requirements of a dependent child Visa (Subclass 445).

  • be a dependent child of the visa-holding parent
  • be sponsored by the numerator or sponsor of the visa-holding parent
  • Must be age under 18 (if over 18, the child must be financially dependent on the parent)
  • A child must have consent to travel to Australia
  • Other requirements such as health, character, and best interest of the child.

As we have discussed, the dependent child visa is a temporary visa. That’s made clear that the child will not get public health care and other benefits as a permanent child visa holder gets. However, there are some benefits that can be useful, such as.

  • move to or stay in Australia until the department of home affairs decides their parent’s permanent partner visa application
  • The Child Applicant can travel to and from Australia any time he wants, while the visa is valid.
  • The Child Applicant can work and study in Australia without any restrictions.

Adoption Visa ( Subclass 102)Benefits & Requirements

Adoption Visa is a little bit more complicated than other Child Visas. However, the Requirements are simple in adoption visas (Subclass 102).

  • The child must not over 18 years of age when adopted.
  • The child must be below 18 years of age while the application is lodged till the decision.
  • The child must be overseas when the visa application is submitted.
  • The child must be in the process of being adopted or adopted by their sponsor parent
  • The child should be sponsored by an eligible adoptive parent or prospective adoptive parent
  • Meet Other basic requirements such as health, character, and best interest of the child.

As the Adoption Visa (Subclass 102) is a permanent residency visa, The benefits in these visas are the same as an Australian Permanent resident without any restrictions, except the child must live with their adoptive parents. The benefits that child can get are:

  • The child can live in Australia indefinitely with their adoptive parent
  • The Child Applicant can work and study in Australia without any restrictions.
  • The child can enroll in Australia’s healthcare scheme, Medicare
  • If eligible, the child can sponsor their relatives to come to Australia with them.
  • If eligible, the child can apply for Australian citizenship
